Welcome to Azhar Construction. This section provides an explanation of this website’s terms and conditions as well as the services we provide. We advise you to read this document in full.

1. Acceptance of Terms

You agree to the terms and conditions listed here by using the website, getting a quote, or hiring us to do construction. Please do not use this website or our services if you disagree with any of the terms. We value the relationships we establish with customers, and transparency is essential. Most of all, we aim to prevent any danger to your property or to our staff.

2. Scope of Services

Azhar Construction offers focused services regarding commercial construction in all of New York. Our specializations are commercial roofing, advanced waterproofing, structural protection, and landmark rehabilitation. We are proud to be a Siplast NDL-certified contractor. This means we can provide roofing elements that are fully compliant with the building codes and are of the highest standards of durability.

We provide a summary of our services on our website. However, individual projects will require additional contracts. Each specific property will determine the services. Your agreement with Azhar Construction and you will define the work that will be done.

3. User Responsibilities & Property Access

After we sign the contract, you agree to provide our employees safe, timely, and secure access to your property. So, they can fulfill their contractual duties, which include but are not limited to inspections, material deliveries, and construction work.

Legally, you must get permission from owners, tenants, neighbors, and any interested parties before work begins. Additionally, you are responsible for removing all personal belongings, vehicles, and any obstruction that may interfere with the construction work. Delays due to construction site access may result in additional costs to you.

4. Payment Terms, Estimates, and Quotes

We provide free estimates for you to calculate the costs associated with your project. However, an initial quote is simply an estimate based on our preliminary review. It is not a binding contract.

After we finalize the scope of work, we will provide a contract with the payment plan. You are required to pay all invoices by their contract specified due date. Failure to honor this means we can stop all work on the construction project until payment is made. We will also charge a fee for any invoice that is paid late.

5. Intellectual Property Rights

All materials on Azhar Construction, including graphics, construction photographs, and all elements of the website, are owned by Azhar Construction. You may not, without our written permission, reproduce, copy, or use our materials for your own commercial purposes.

Conditions attached also apply to project proposals, including designs, drafts, and construction plans. These remain our IP until we are fully compensated for the project.

6. Limitation of Liability and Disclaimers

Construction and rebuilding work have a lot of risk. While we are compliant with safety and building code standards, Azhar Construction cannot see all of the issues. We are not liable for any structural issues, hidden mold, or any hazardous materials that may be present before work begins.

We do everything to ensure we finish a project on time. That being said, we are not liable for delays caused by adverse weather conditions, unavailability of materials, a stop-work order due to a labor strike, a change in building codes that apply to our work, or any other events that are beyond our control.

7. Governing Law

Azhar Construction is located in New York. With that, the regulations for these terms and conditions of use are under the Construction Law of New York. Coverage of this agreement will be in the state courts and, if needed, the federal courts.

8. Termination of Service

If we find you in breach of these Terms and Conditions, we may stop providing you with services or cancel your contract with us. We may also cancel our relationship with you if you do not pay us on time, create a dangerous work environment for our employees, or do not comply with applicable building regulations. If we stop providing services to you, you will owe us for the costs of materials and labor done before the termination date.

9. Alterations to Terms

Every time there’s a new business practice, a new construction regulation, or a new law, these Terms and Conditions may change. Each time this happens, we will change the “Last Updated” date on this document. Please check this document periodically. If you keep using our website and services, we will consider you to have accepted the new Terms and Conditions.
